Acceptance of Terms

By registering for membership, accessing our website, or using the facilities of NEWGEN FITNESS, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services. These terms constitute a legally binding agreement between you ("Member", "you") and NEWGEN FITNESS ("we", "us", "our").

Membership Terms

• Membership is personal to you and may not be transferred or shared with another person.
• All membership fees must be paid in full before access to the facility is granted.
• Membership duration begins on the date of payment and expires at the end of the selected period.
• Automatic renewal may be offered. Members will be notified before any renewal charge is processed.
• Membership cards or QR codes are required for entry and are non-transferable.
• The gym reserves the right to refuse entry or terminate membership for violation of policies.
• Members must be at least 18 years old. Minors between 14-17 may use the facility with parental consent and supervision.

Cancellation and Refund Policy

All membership payments are non-refundable after successful payment and registration. By completing your payment, you acknowledge and agree that:

• No refunds will be issued for partially used membership periods, whether daily, weekly, monthly, or yearly.
• Membership fees cannot be transferred to another person or exchanged for goods or services.
• In exceptional circumstances such as medical incapacity (with valid medical documentation), management may consider pro-rated credits at its sole discretion.
• If NEWGEN FITNESS is forced to close for an extended period due to unforeseen circumstances, membership durations may be extended accordingly.
• Cancellation of automatic renewal can be requested at any time before the next billing cycle.

Gym Rules and Conduct

Members must at all times adhere to the Member Policy (Newgenite Agreement) as outlined in our Policies page. Key rules include:

• Treat all staff, coaches, and fellow members with respect and courtesy.
• Proper gym attire and clean training shoes must be worn at all times.
• Equipment must be used responsibly and returned to its proper place after use.
• No smoking, alcohol, or illegal substances are permitted on the premises.
• No aggressive, threatening, or violent behavior will be tolerated.
• All safety instructions provided by coaches and management must be followed.

Liability Disclaimer

• Use of gym facilities, equipment, and participation in classes is at your own risk.
• NEWGEN FITNESS is not liable for any injury, loss, or damage sustained while using our facilities, except where caused by our negligence.
• Members are advised to consult a medical professional before beginning any fitness program.
• The gym is not responsible for lost, stolen, or damaged personal belongings. Lockers are provided for your convenience.
• CCTV footage is recorded for security purposes. Footage may be shared with law enforcement if required by law.

Intellectual Property

All trademarks, logos, content, and materials on the NEWGEN FITNESS website and within the facility are the intellectual property of NEWGEN FITNESS. Members may not reproduce, distribute, or use any of our intellectual property without prior written consent. This includes but is not limited to workout programs, training methodologies, branding materials, and digital content.

Changes to Terms

NEWGEN FITNESS reserves the right to modify or update these Terms and Conditions at any time. Members will be notified of material changes via email or through announcements posted at the facility and on our website. Continued use of our services after changes constitute acceptance of the updated terms. We encourage members to review these terms periodically.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Benin City, Edo State. We encourage informal resolution of disputes before resorting to legal proceedings.
